Warning Signs of Elderly Abuse and Neglect in Nursing Homes

Elder abuse and neglect can happen due to mistreatment occurring in residential facilities, like nursing homes.  Often, elder abuse is done by those who are trusted to provide the elderly with care and protection.  Common forms of elder abuse and neglect include physical abuse, emotional and sexual abuse, financial exploitation, and abandonment.  It is important to be aware of the warning signs of the different forms of abuse, so you can make sure your elderly family members are not suffering from abuse.

Warning Signs of Elder Abuse and Neglect

  1. Your loved one has difficulty getting around or has become immobile due to lack of caregiver assistance when it comes to daily walking and exercise programs.
  2. Your loved one has developed poor hygiene, including wearing dirty clothes, smelling of feces or urine, body odor or unwashed hair due to lack of basic personal care.
  3. Your loved one has broken bones, bruises, cuts or scratches that are unexplained and may have occurred due to rough handling during transfers or force feeding or may have occurred during medicine administration.
  4. Your loved one is experiencing confusion or drowsiness or has begun sleeping during most of the time they are awake as a result of a medication overdose or adverse side effects to medication which are unmonitored and unresolved.
  5. Your loved one has developed pressure sores (bedsores) as a result of improper caretaking.
  6. Your loved one has become withdrawn and has started to show a lack of interest in their favorite activities.

In general, residents living in assisted living facilities are more capable of managing their daily activities than those that reside in a nursing home, such as eating, grooming, and moving from place to place.

Although assisted living residents are more independent than the residents of nursing homes, these residents may still suffer from elder abuse.  It is imperative that the family members and residents of assisted living facilities are aware of what is happening inside the facility.  In situations where assisted living abuse is suspected, the residents or their families must seek out an attorney with experience in the area of elder abuse law right away.

Types of Assisted Living Abuse

There are many different forms of assisted living abuse.  This type of abuse can involve psychological, sexual, or physical abuse.  In addition, assisted living residents may also suffer from abuse as victims of financial exploitation or neglect.

  • Psychological Abuse: This type of abuse can happen with verbal assault, bullying, harassment, and degradation.
  • Sexual Abuse: Sexual abuse can occur when a person engages in a non-consensual act of a sexual nature with a resident of assisted living.
  • Physical Abuse: Physical abuse involves any type of unwarranted physical harm, including hitting, slapping, kicking, and pushing.  Additionally, physical abuse may also include excessive restraints or improper use of restraints.
  • Financial Exploitation: This type of abuse occurs when a resident in assisted living is taken advantage of in a financial manner.  This can include the unauthorized use of the resident’s money or property for the benefit of the perpetrator or someone else.

Elder Abuse and Neglect in Assisted Living Facilities

Assisted living abuse has been on the rise.  This type of neglect and abuse involves mistreatment of residents in assisted living facilities and is becoming an important issue in healthcare.  It’s estimated that around four to five percent of residents in assisted living facilities have suffered some type of mistreatment or abuse.

Limited Research on Elder Abuse

Presently, there is limited research about the prevalence of assisted living neglect and abuse for multiple reasons.  One reason for the lack of research is that these incidents of abuse and neglect are often unreported.  Some of the reasons why the victims do not report this abuse include: embarrassment, the frailty of the victim, and a lack of physical means to report it, such as a lack of access to a phone or having a disability that prevents them from making a report.

Riskiest Environments for Elder Abuse

Studies indicate that elderly individuals are at a greater risk for abuse and neglect at larger assisted living facilities with a high number of patients and staff.  These studies determined that there were significant correlations between the amount of beds in a facility, high rates of staff turnover, the number of aids, and number of nurses, along with total incidents of mistreatment of patients.  Additionally, there was found to be a positive correlation between physical nursing home neglect and the staff-to-patient ratio of the facility.  There was also a positive correlation between the total number of mistreatment events per patient and the staff ratio of the assisted living facility.
